2. Scope of these terms
These Terms of Service apply to your use of the Visuallence website and to contact or booking requests submitted through it. They do not replace a separate written contract, proposal, statement of work, invoice, order form, or agreement signed or accepted for a specific project.
3. Services
Visuallence provides creative and digital services, including website development, design, social media, digital marketing, photography, marketing campaigns, consulting, and related services.
Services may be provided to both business clients and individual clients. The exact scope, price, timeline, deliverables, revisions, and responsibilities are agreed separately for each project.
4. No online payment processing
Payments are not processed directly through this website. Any payment terms, invoices, deposits, due dates, taxes, or billing details will be communicated and agreed separately outside the website.
5. Booking a call
The booking form allows you to request a call or meeting. A booking request does not automatically create a paid service contract. We may contact you to confirm, reschedule, reject, or clarify the request.
6. Offers and proposals
Any estimate, proposal, or commercial offer is valid only for the period stated in that document. If no validity period is stated, the offer may be updated or withdrawn before acceptance.
7. Client responsibilities
For project work, clients may be required to provide accurate information, content, brand assets, access credentials, feedback, approvals, legal materials, and any other elements needed to complete the work. Delays in providing these materials may affect timelines.
8. Intellectual property
Unless otherwise agreed in writing, the client receives rights to final paid deliverables after full payment. Drafts, rejected concepts, internal methods, source files, templates, tools, reusable code, know-how, and pre-existing materials remain the property of Visuallence or their respective owners unless expressly transferred.
Third-party assets such as fonts, stock images, plugins, software, or platform components may be subject to their own licenses.
9. Portfolio use
Unless otherwise agreed in writing, we may reference completed work, project names, screenshots, visuals, or case-study summaries in our portfolio, social media, or marketing materials. Confidential or sensitive information will not be intentionally disclosed.
10. Website content
The website content is provided for general information. We try to keep information accurate and updated, but we do not guarantee that all content is complete, current, or free from errors at all times.
11. Prohibited use
You must not use the website to send spam, malicious code, false information, illegal content, automated abuse, attempts to compromise security, or content that infringes third-party rights.
12. Third-party links and tools
The website may include links to third-party services such as social media platforms, Google tools, or external websites. We are not responsible for the content, policies, availability, or practices of third-party websites.
13. Limitation of liability
To the maximum extent permitted by applicable law, Visuallence is not liable for indirect losses, loss of profit, loss of data, business interruption, or issues caused by third-party platforms, hosting providers, plugins, software, or client-provided materials.
14. Consumer rights
If you are a consumer, you may have rights under applicable consumer protection law. Any legally mandatory consumer rights remain unaffected by these terms.
